To all whom these Presents shall come – Greeting: KNOW YE, by virtue of two land office treasury warrants, to wit: Seventy one acres by exchange warrant number eight hundred and fourteen issued the twenty sixth of September Seventeen hundred and ninety seven, and forty seven acres by number three thousand three hundred and fifty two, issued the first day of February, eighteen hundred and two, there is granted by the said commonwealth unto Randolph Lively a certain tract or parcel of land containing one hundred and eighteen acres by survey bearing date of the twenty seventh day of April eighteen hundred and four, lying and being in the county of Kanawha, on the west side of Cole River, above Island Creek joining and above a survey made for Marshall Bowman and bounded as followeth to wit: Beginning at two sugar trees, two lynns, two dogwoods and beech on the bank of Cole River, at the mouth and lower side of a drain, just at the lower end of narrows corner to Marshall Bowman’s survey of one hundred and fifty three acres, thence up the river with the meanders thereof and binding thereon four hundred and fourteen poles to two sugar trees and two maples on the bank below narrows, thence leaving the river west twenty two poles to two white oaks on the hill side near the top, north forty three degrees west one hundred and ten poles to two white oaks on the point of a hill, north three degrees (image ran off bottom of page and some text was lost.) rocks to a white oak and maple north forty four degrees west thirty nine poles to an ash beech and then on a branch north thirty six degrees west thirty two poles to a black oak and dogwood on a hill side, north fifty four degrees west forty two poles to three beeches by rocks and a drain north eighty five degrees west forty poles to an ash buckeye and lynn by a drain and a large rock corner to said Bowman’s survey, and down said drain with Bowman’s line. North five degrees west thirty-two poles to thee beginning with its appurtenances. General Notes: Thomas Lively, known as Old Tom, is mentioned in payroll documents as a Loyalist fighting in the Battle of Post Ninety Six, S.C. alongside his father and brothers.

31. Reuben Lively [2954] was born in 1756 in America and died in 1826 in Rawdon, Nova Scotia at age 70.

General Notes: Reuben Lively Sr. was from the 96 District in South Carolina and served as a private in Col. John Cotton's, Stevenson Creek Militia on the side of the British in the American Revolution.

From the John Duncanson book on interlibrary loan, 0-921341-34-2: "Rawdon and Douglas: Two Loyalist Townships in Nova Scotia".

Rawdon Township (now in Hants Co, Nova Scotia) was formed in 1784 by the government of Nova Scotia "for the Loyalist refugees from the 96th District, South Carolina and St. Augustine, Florida."

96th District is in the extreme northwest corner of South Carolina and had been Indian Territory up to at least 1766, some of which was only settled after that date by settlers moving south and by new arrivals from North Ireland, Yorkshire, England, etc.

After the American Revolution began in 1775, action in South Carolina was limited to skirmishes until the fall of 1779 when the British launched a major campaign taking Charleston and establishing military posts from Camden to the 96th District. However, on 1781, May 22, the Americas under General Nathaniel Greene and Henry "Light Horse Harrly" Lee (father of Robert E. Lee) attacked the 96th District post. The post held out but finally on June 21, 1781, Lord Rawdon, Commander of British forces in South Carolina ordered the evacuation of the 96th District post and loyalist refugees moved to Orangeburg, and later to Charleston. Charleston itself was evacuated to Halifax, Nova Scotia in October 1782 and included the 96th District loyalists, which also included Reuben Lively.

On August 3, 1784, a grant of 24,500 acres was made in Rawdon township, Nova Scotia to 57 settlers, "most of whom were loyalist refugees from the old 96th District. This grant is sometimes referred to as "The Bond Grant" after Captain James Bond, one of the settlers from the 96th District, and a recognized leader among the Rawdon settlers. Reuben Lively of the 96th received 500 acres in this grant.

Reuben Lively, loyalist claim #104 dated July 1786 stated that he was a native of America, settled in the 96th District of South Carolina in 1775. He avoided service with the Americans by being under age; served with them for 6 months but only against the Indians. His father was friendly to Great Britian but was killed by the rebels in 1781. Reuben joined the British at the 96th District post after the taking of Charleston by the British in the autumn of 1779 and served in the militia until the fall of the 96th District. He had 250 acres in the 96th District from his wife. They were married in 1780, her family was named Cameron. He also had 200 acres from his wife valued at 10 shillings per acre. Had 15 horses, 30 cattle, 6 negroes, all lost to the Americans.

The Thomas Thornton claim said that two of his infant brothers were in the care of Reuben Lively. Thomas received a 250 acre grant.

He was buried at the Anglican Church, St. Pauls, Upper Rawdon, Nova Scotia.

32. John Porter Lively [2479] was born in 1760 in Abbeville County, South Carolina, died on 31 Mar 1828 in Sparta, Illinois at age 68, and was buried in Lively Cemetery, Randolph County, Illinois.

General Notes: John is mentioned in British Payroll abstracts as a loyalist fighting against American revolutionary forces un General Nathaniel Greene at the Battle of Post Ninety Six alongside of his father and brothers. 1780-81.

Sometimes called "Old John".

John's second wife's father, Joseph Anderson, served in the Revolutionary War. He was killed by Indians April 14, 1806. His name appears on a bronze plaque at the Sparta High School. He served under George Rogers Clark, 1779-1781 through various campaigns against English forts. Later he traveled often between Abbeville, South Carolina and Randolph County, Illinois quite frequently.

John Lively settled on section 4 of Randolph County, Illinois, now Central Township. Lively Prairie was named after John. He received land patents for areas of section 9 in 1816 and 1818. The three quarter section of land was divided among his sons, William, Hugh Porter, and Turner in 1824.

John is listed on a bronze plaque on the grounds of the Sparta Illinois high school. The plaque lists all the names of the Revolutionary Patriots from Randolph County.

ABOUT LIVELY PRAIRIE
Located in Township T5 R6 is Lively Prairie, Illinois. The first settler in the area was John Lively in 1805, he settled in Section 4. John died in 1826. His sons: Reuben, James, Turner, William and Hugh P. remained on the prairie. The Livelys were followed by Andrew Border in 1816, Samuel Crawford, James Hugh, William Morris and others.

From 1859 Montague's Business Directory: page 89:

"1805--John Lively a brother of Joseph, who came at the same time, settled in the Prairie northeast of the Irish settlement, from which circumstance the prairie has been called "Lively Prairie." He was the pioneer of that part of the county, and sustained his position in a manner which excites sentiments of pride in his decendants. He lived in this prairie during his life, which closed in 1826. Reuben Lively, who lives near Athens, in St. Clair County, is the oldest son of John Lively. His other sons were James, Turner, William and Hugh P.--the latter was accidentally killed by the falling of a tree. Turner and William are residents of the prairie where their father lived. James is dead.""

General Notes: Joseph appears in the 1800 census of Abbeville, South Carolina with his wife and three sons, all under 10 years of age. Joseph Lively came to Illinois Territory in 1805 and settled three miles from Kaskaskia. He lived on his farm until 1823 when he moved and settled on the old Judge John Campbell residence.

General Notes: Judy Lively is placed here as speculation in the hope that someone with knowledge of Judy Lively can further enlighten us. The information we have is in the following:
Francis Gaines was born in Albemarle County in 1759 (per gravestone inscription, Elbert County, Georgia). Elbert County records confirm that he married Judy Lively and the date of the marriage has been set in 1783-87 ( Some say it was 1792). Francis would have been 24 in 1783. Francis died in 1825 at 66.

There is a suggestion on RootsWeb (Ethics-in-Genealogy-L) that Judy was a descendant of the Mark Lively family. In speculating where Judy Lively came from, it says, " . . . there was a Lively family living in the Buck Island community in Albemarle County, making such a marriage possible."

As you recall, no daughters of Mark were mentioned in his will and he cut out his two oldest sons, one of which was William. True to family tradition, those Livelys not mentioned in the will moved on to other places. Francis Gaines and wife Judy " . . . moved from Virginia to Georgia (1792) by way of an Indian trail which later became U. S. 29." (Salisbury Post (Georgia Newspaper))

General Notes: A marker for Francis Gaines, a Revolutionary soldier, was dedicated in the Francis Gaines Cemetery in Elbert County, Ga., on May 1.

Francis Gaines was born in 1759 in Albemarle County, Va., a direct descendant of Sir John Gaines, who came from Brecon, Wales, to America about 1606. Francis Gaines served as an officer in the Revolution.

In 1792 Francis Gaines married Judy Lively and moved from Virginia to Georgia by way of an Indian trail which later became U.S. 29. He was granted 1,200 acres of land for his war service.

The pine log Gaines home, hewn with axes, was located on the west side of Rock Branch. There was a large spring north of the house. His slave quarters were across Rock Branch from his house.

Gaines drew land in several land lotteries, then bought and sold other lands after moving to Georgia. He was not an educated man; he could not even write his name. He was, however, a smart business man and eventually owned many wheat and corn mills on Coldwater Creek and Pickens Creek.

Some of the original land grant is still in the Gaines family, never sold or traded outside the family. Francis Gaines was a generous person, however, and gave some of the land to various churches.

Francis Gaines died in 1825, and his will was recorded in Elbert County. He willed all his assets to his wife for her lifetime except for his shotgun, which he willed to his oldest son.

A grown-up family of three brothers, Daniel, John and William and four sisters, Mrs. William Gettys, Mrs. Lewis Lively, Mrs. Gordon and Mrs. Oliver.

They came from near Gettysburg. Their oldest brother, Walter Carson emigrated to lndiana where he raised a family. (Walter Carson was in Rutherford in 1790 and 1800 at least, and apparently lived in Rutherford County for some time before moving on to Indiana.) Daniel had married a McFarland, and John and William were single. John Carson (Married) Mary Withrow, daughter of Capt. James Withrow, who served in the War for Independence and took part in the defeat and capture of Col. Patrick Ferguson, 300 English regulars with 800 Tory militia.
