He was mustered into service at Birch River, Nicholas Co., VA now West Virginia. He was taken prisoner in Greenbrier Co., WV 11/26/1862 and died on the Mississippi River under Federal Troops from typhoid fever on 12/27/1862.

About John Lively and his father Thomas:
Both John Lively and Thomas Lively were listed as heads of families in the 1820 census of Pendleton County, South Carolina, and the 1830 census of Pickens County, South Carolina.
In 1820 John's family had a male aged 26-45, two males 1-10, a female 26-45, a female 10-16 years, and two females 0-10 years.
By 1830 his family included a male aged 40-50 years, a male 15-20 years, two males 5-10, one female 10-15, and two females 0-5 years.
Prior to 1840, John moved with his family to Cass County, Georgia. In the census of that year, the family consisted of a male aged 50-60, a male 15-20, a female 50-60, a female 15-20, and two females 5-10. The 1840 census of Cass County, Georgia also shows that John owned 9 slaves. In 1850 John Lively was living in Walker County, Georgia as were his three known sons and daughter Tilithia, all married and without families. Judea A. P. Lively was single and living with her father in 1850. John's wife Elizabeth died in March of that year.
By 1852 John Lively had moved to Texas with his sons John W. Lively and Reuben Lively. Son Thomas had preceded them to Texas, presumably sometime late in 1850. In 1860, John was living with his sons, John Wesley's family home in Houston County Texas.
John's name has occasionally been given by recent descendents as John Thomas and even Thomas and Tommy. Official documents discovered so far have given his name only as John Lively.
The first written record of Thomas Lively is in the census of 1790, Edgefield County, South Carolina. On this date his family included two males aged 16 and over, one male under 16 years of age, and four females.
In 1800, Thomas was living in Abbeville County, South Carolina. The census that year listed his family as one male aged 45 and over, one male 16-26, two females over 45, 3 females 10-16, and two females 1-10. The 1810 census, Abbeville County, South Carolina, lists Thomas and his family as: one male 26-45, one female over 45, 3 females 16-26, one female 10-16.
Pendleton County, South Carolina was Thomas' home when the 1820 census was taken and his family then included one male 45 and over, two males 1-10, one female over 45, one female 26-45.
Although Thomas was recorded living in 4 different counties between 1790 and 1830, this may represent as few as two different locations. The County of Abbeville, Edgefield and Pendleton, as they were organized, were all a part of the original 96 District. District and County were used interchangeably. In 1785 Abbeville and Edgefield County were split off from from District 96. Since Abbeville and Edgefield had one common boundary until 1897, it is possible a slight adjustment in boundary definition would cause what appears to be a relocation, even when a relocation did not take place.
A further study of county formations reveal that Washington County was taken from District 96 in 1795. In 1798 Washington County was divided into Greenville County and Pendleton County. Then, in 1826, Pendleton County was divided into Anderson and Pickens Counties.
One family tradition reports that Thomas Lively was born and reared in Virginia. This tradition maintains that he was a patriot and served in the Revolutionary War during which time his wife spun clothes, made his clothes, and shipped then to him while being closely watched by Tories. No official record of his Revolutionary War experience has been found.
Thomas and John Lively, both residents of Pickens County, sold 300 acres on January 30, 1836 to John Clayton. This land was on the north side of Twelve Mile River adjacent to the Rice Creek and John Stewart line. The deed was witnessed by Thomas Lively, Jr., and recorded August 18, 1836. John, in one place within the document was identified as John Sr., and Thomas Sr., the grantors of the deed, made their marks indicating they could not write.
Thomas Lively purchased 150 acres on Prather Creek in Pickens County, October 1, 1835 from John Nabour and his wife Winney.
The Thomas Lively will was probated June 10, 1839 in Pickens County giving a life estate to wife Rachel. His land on the west sided by Stewart's Creek and Roberts McCann's line went to son John Lively, while the land on the east side went equally to daughter Jane and son Mark.

General Notes: Reuben lived a short distance southeast of New Athens and operated the "Wild Duck" ferry across the Kaskaskia River. He also operated the Lively Tavern nearby. Veteran War of 1812. Reuben Lively is listed in Captain Jacob Short's Company as Private Reuben Liveley.
About 1810, Nathaniel Hill, Joshua Perkins, Reuben Stubblefield, James and Reuben Lively and Richard Beasley, senior, located in the same neighborhood. As a protection against the Indians, they constructed a block-house on Dosa creek, near the present site of Hillstown, (named for Nathaniel Hill.) It was built in the prevailing style of such structures, two stories high, the lower one provided with port-holes to shoot through, and also with strong puncheon doors, securely barred against entering from the outside. The second story projected over the first, enabling parties secreted within it to shoot down upon Indians attempting to gain access into the lower story. It was to this block-house that a son of Lively, who had been murdered in Washington county in March, 1813, and a hired man, made their escape before blood-thirsty savages. An account of this terrible tragedy may not be here amiss. Lively had left his home in this precinct to make a new one near Covington, Washington county, in company with David Huggins, a brother-in-law. They made one crop without being molested, in 1812. In 1813 Huggins returned to Monroe county. Friends importuned Lively to give up his place and join them at the block-house. He resolutely declined, saying, he had no fear of the red skins. His wife seemed to have a presentiment of the terrible scenes that were soon to be enacted. An account of the massacre, in the History of Washington county, is as follows: Lively had an enclosure into which he had his stock driven at night, to protect them from marauding bands of Indians. For several nights previous to the night that witnessed the fearful tragedy, Lively and his family were greatly disturbed. The stock gave evidence of their alarm by their unusual conduct; the dogs barked continuously, and Lively began to realize the imminent danger of himself and family. He frequently, with rifle in hand, would go out and search for the cause of the alarm, but his efforts to discover the source were unavailing. He endeavored to calm his wife's fears by telling her it was nothing but wolves or other wild animals that created the disturbance. This, however, did not suffice to quiet her feelings, and she labored more assiduously to convince her husband that their safety depended on their immediate removal to the fort. The last night before the massacre was so exceedingly noisy that Lively began to lose his composure, and agreed to accede to the request of his wife and go to a place of safety. He began preparations for moving about two hours before sundown. He directed his son, hired hand and his nephew, to get up the horses while his wife and daughters milked the cows, and got things in readiness to start to the settlements. The young man and boy started in quest of the horses, leaving the old gentleman in the cow-pen with his wife and daughters, who were milking the cows. He was on the stump of a fallen tree with. his loaded rifle across his knees ready for use, chatting with his wife and daughters, whose spirits were buoyant in anticipation of leaving that dreaded place. But alas! their fond hopes were never to be realized! The young man and boy had proceeded but a short distance in the direction of the horses, when they were alarmed at the report of fire-arms in the direction of the house. They hurried to the scene of the firing, and when they had come in sight, a scene met their gaze that was calculated to freeze their hearts! The premises were covered with Indians; the death-dealing tomahawk and scalping-knife were doing their work of destruction. All were found where they were slain, on the premises, scalped, and their. bodies horribly mutilated, except one boy, who was found by a party that followed the Indians, beheaded and with a hole cut through his body, with his buckskin shirt drawn through it."
The young man and boy made their way on foot to the block wading Little Mud creek, whose waters were so high, that they reached the boy's chin. They gave the alarm, and all occupants of the fort able to bear arms followed the savages, some of whom they killed.
Upon the abandonment of the block-house its occupants scattered to various parts of the country, only two or three families remaining in the neighborhood.
There are yet living representatives of the Hills and Livelys in this county. These pioneers followed the usual avocations and endured the hardships incident to such life. One of the Livelys located on section 34, where he lived for a number of years. To him whilst living here was born Mary Lively, who first enlivened the humble cabin of the Livelys in the spring of 1816. Peace had spread her fair wings, and when bands of Indians of the Tamarois tribe occasionally stopped at the house, they admired the little pale face, and bestowed on her presents more brilliant than useful.
