Postmaster at Roseville (Lively), West Virginia which was kept inside his store for many years.
Jacob Lively, one of the oldest and most prominent residents of Paint Creek, died Wednesday, March 8, at the Oak Hill Hospital. Death was due to Bright's disease and complications. Mr. Lively was 71. He was a merchant at Lively for many years and was one of the most honorable and upstanding citizens of the county. He is survived by his wife and five children; two brothers and three sisters.
Jacob Lively Will - - The will of Jacob Lively was filed for probate at the County Clerk's Office and is quite lengthy and distributes the estate in detail. Dated June 7, 1920, it is witnessed by E. E. Morris, L. M. Hickman and W. H. Boone. The Will:
I bequeath to my wife Kate E. Lively, 15 shares of New River Company preferred stock. Also the household and kitchen furniture of which I may possess at the time of my demise.
I bequeath to Zelotes A. Lively, Cleavy T. Lively Coleman, Norma O. Lively Wikle and my grandchild Daphne Canterbury, daughter of Sallie F. Lively Canterbury, all of my property, real, personal and mixed except as here in after provided.
My son, C. M. Lively, on February 13, 1909 made his note payable to me in the sum of $755.96 and on December 2, 1910 his note payable to me for $115.17 but said notes are subject to certain credit endorsements thereon and I direct that these notes be collected by my executors, but if all the other legatees are willing, C. M. Lively may be released from payment of interest on the notes but if they do not agree then it is my desire that 3 percent be charged.
I direct my executors to partition all the surface land to Zelotes Lively, Clevy Coleman, Norma Wikle and Daphne Canterbury taking into consideration quantity, quality, location and value.
I direct all my executors to sell all of the coal and other minerals that I may own. Also stock in New River Hardware Company and proceeds to be divided by executors equally among Zelotes Lively, Cleavy Coleman, Norma Wikle and Daphne Canterbury.
Children and grandchildren have received advancements paid as follows: C. M. Lively, $1,560; Zelotes Lively, $1,197; Owen Lively, $1,560; Clevy Coleman, $1,000; Norma Wikle, $966.45; Daphne Canterbury $404 and executors are to consider these advancements and deduct same in distribution of estate.
C. M. and Owen Lively are to receive $1 each, said amount to be the total amount received by them in addition to amounts already paid them. . . . . . . . .
Distribution of the real estate is made as follows: Clevy Coleman, part of the home place bordering on and adjoining land owned by Owen Lively. Zelotes Lively to have land lying next to Clevy Coleman and Norma Wikle next including house, lot, etc., after death of Kate Lively. The Lower end of the home place goes to Daphne Canterbury. Cash advancements are noted to heirs of $100 each to Zelotes Lively, Norma Wikle and Daphne Canterbury, and $200 to Clevy Coleman. The second codicil lists the following cash payments: Zelotes Lively $287.57; Norman Wikle and Daphne Coleman $100 each; Clevy Coleman $200.

Jacob next married Margaret Smith [4066] [MRIN: 1426], daughter of Joseph Lewis Smith [4371] and Nancy Williams [4392], on 24 Nov 1875 in Raleigh County, West Virginia.
